SPHINX TRIVIA OFFICIAL CONTEST RULES (“Rules”)

CONTEST AND SPONSOR

NO PURCHASE OR PAYMENT IS NECESSARY TO DOWNLOAD  SPHINX - LIVE TRIVIA GAME (“CONTEST”), ENROLL TO THE CONTEST OR WIN IT.

The Contest is operated and sponsored by Atom Operations Limited (“Sponsor”), located at 116 Main Street, P.O. Box 3324, Road Town, Tortola, British Virgin Islands.

THE CONTEST IS NOT SPONSORED, ENDORSED, ADMINISTERED BY, OR ASSOCIATED WITH APPLE INC. OR ITS SUBSIDIARIES OR AFFILIATES.

ACCESS AND ELIGIBILITY

Any person over 17 years of age at the time of entry may participate in the Contest. Any parties engaged in any ways in the development of the Contest are not eligible to enroll, participate, or win the Contest.

The Contest is void where prohibited or where restricted by law, or where bonding, registration, or any other requirements would be required but have not been met, or where the methods of entry would be deemed consideration.

CONTEST ENROLLMENT AND PROCESS

  1. Download SPHINX - LIVE TRIVIA GAME mobile application (“App”) from the App Store. If you have already downloaded the App, you shall open it on your mobile device.
  1. Sign up or log in with your existing credentials, if you have already signed up. You may sign up with the help of your e-mail address or Facebook profile.
  1. Live trivia game (“Episode”) will be announced in the App from time to time. You will receive a notification about an Episode start. You may join an Episode when it is live. Sponsor reserves the right to cancel or postpone an Episode, in its sole discretion, without any restrictions.
  1. Join and play an Episode either by (i) opening a push notification with direct transfer to an Episode or (ii) automated transfer from the home screen of the App or (iii) with a help of in-app alert signaling about an Episode start.
  2. During an Episode, you will receive questions to be answered. If you answer a question correctly within a specified during an Episode timeframe, you will proceed to the next question and receive a certain amount of experience points. If you answer incorrectly or do not provide an answer within a specified during an Episode timeframe, you will be eliminated.

    If you answer all questions of an Episode correctly, you will become a winner of a particular Episode. There may be several winners in a particular Episode in case more than 1 player answered correctly to all questions of an Episode. There may be no winners, in case no players answered correctly to any question during an Episode.

    The winners of each Episode will receive an in-app reward in a form of experience points. In case of multiple winners during particular Episode, they will all receive experience points.

    The amount of experience points is calculated based on each correct question answer and is dependent on your Trivia Camp level and a number of players that have been eliminated during a particular question.

    In case of elimination during a particular question of an Episode, a player will still receive experience points based on a number of questions answered correctly.

    All experience points earned by a player during Episodes are cumulatively tracked in the App's scoreboard ("All-time Scoreboard"). All players will be ranked in the All-time Scoreboard in a descending order based on experience points earned while participating in Episodes.

  1. Weekly Sprint. The Sponsor may from time to time initiate, upon its own discretion, a weekly contest ("Weekly Sprint"). Weekly Sprints are held in the form of periodical rounds. Each round of the Weekly Sprint usually lasts for 7 (seven) days ("Sprint Period"). The beginning, end, or duration of the Sprint Period may be changed, due to, but not limited to, the following reasons: lack of interest from the players, server hardware issues, network issues, master Server issues, Sponsor's discretion, etc.
  2. The player, who earns the highest amount of experience points during the Sprint Period, will become a winner of a particular Weekly Sprint (“Winner”). There may be no Winner, in case no player received experience points during the Weekly Sprint.

    All experience points earned by a player during a particular Weekly Sprint are cumulatively tracked in the App's weekly scoreboard (“Weekly Scoreboard”). All players will be ranked in the Weekly Scoreboard in a descending order based on experience points earned during particular Sprint Period.

  1. Extra Lives. Players may utilize an “Extra Life” to keep playing during an Episode in case of an incorrect answer. Players may use an Extra Life only once per Episode and it shall not be used during the last question of an Episode.
  1. The offline mode (“Trivia Camp”) allows you to answer trivia questions in the App beyond the Episodes and without connecting to the Internet every time you wish to play.
  1. Virtual Items. The App may include virtual currencies (“Virtual Coins”), items or services for use within the Contest (“Virtual Goods”), paid subscriptions (“Subscriptions”), and virtual prizes (“Virtual Tickets”). Virtual Coins may be purchased or acquired for your certain actions as specified in the App and may be spent for Virtual Goods.
  2. You agree that once acquired Virtual Coins, Virtual Goods and/or Subscriptions (“Virtual Items”) have no monetary value and can never be exchanged for real money, real goods, or real services from us or anyone else. You agree that Virtual Items and Virtual Tickets (together “Virtual Objects”) are not transferrable to anyone else and you will not transfer or attempt to transfer any Virtual Objects to anyone else.

    You do not own Virtual Objects but instead you purchase a limited personal revocable license to use them – any balance of Virtual Objects does not reflect any stored value.

    We reserve the right to control, regulate, change, or remove any Virtual Objects without any liability to you at any time. In addition, we may revise the pricing for Virtual Items offered through the App at any time.

    We may limit the total amount of Virtual Objects that may be acquired at any time, and/or held in your account in the aggregate.

    If we suspend or terminate your account, you may lose any Virtual Objects that you may have and we will not compensate you for this loss or make any refund to you.

  1. Prizes. The Winner of each Weekly Sprint and players, who will take places from 2nd to 3rd (“Runners-Up”) in such Weekly Sprint, will receive an in-app reward in a form of Virtual Tickets. The Sponsor will inform the players in the App about (i) the overall amount of Virtual Tickets, available for each Weekly Sprint (“Prize Pool”), and (ii) the percentage of the Prize Pool attributable to the Winner and Runners-Up.
  2. A player may exchange Virtual Tickets for an Amazon.comĀ® gift card code of a certain value (“Prize”) subject to provisions of this Section. Each Virtual Ticket will be equal to 1 (one) US$ of the Prize.

    To initiate the Exchange, a player shall enter an email in the designated field in the App. We will contact such player by email and request information required to proceed with the Exchange. Such player shall respond to our email within 7 (seven) days after the receipt. If a player fails to respond to the said communication within the aforementioned term, the Prize may be deemed unclaimed and the Sponsor will have no further obligation with respect to the Prize.

    The Sponsor will present a player with the Prize within 1 month after the player provides information requested by the Sponsor. The player is solely responsible for providing the correct details.

  1. Taxes. Each player who receives the Prize is solely responsible for reporting and paying any and all applicable taxes (if any).
  1. Decisions. By participating in the Weekly Sprint, players agree and acknowledge that the scores indicated in the Weekly Scoreboard will be used to determine the places of the participants in the Weekly Sprint.
  2. The Sponsor reserves the right to disqualify any player of the Weekly Sprint and may refuse to award the Prize to a person who is ineligible or has violated any provision of these Rules, gained unfair advantage in participating in the Weekly Sprint (including, but not limited to, use of bugs, bots, hacks, etc.), or participated in the Weekly Sprint using fraudulent means (including, but not limited to, by engaging in collusion schemes with other players). The Sponsor will solely interpret these Rules and resolve any disputes, conflicting claims or ambiguities concerning the Rules or Weekly Sprints. The Sponsor's decisions concerning such disputes shall be final. If the conduct or outcome of the Weekly Sprint is affected by human error, any mechanical, technical, electronic, communications, telephone, computer, hardware or software errors, malfunctions or failures of any kind, intentional interference or any event beyond the control of the Sponsor, the Sponsor reserves the right to terminate the Weekly Sprint, or make such other decisions regarding the outcome the Sponsor deems appropriate.
